These Terms of Sale apply to purchases of products from our website. By placing an order, you agree to these Terms of Sale in addition to our Terms of Service, Return & Refund Policy, Shipping Policy, and Privacy Policy.
1) Eligibility & consumer status
You must be 18+ to purchase.
We sell primarily to UK consumers for domestic use. If you buy for business/resale, consumer remedies may not apply.
2) Orders & contract formation
Your order is an offer to buy. We’ll email an order confirmation when received.
A binding contract forms only when we dispatch the item(s) and send a dispatch confirmation.
If we cannot accept your order (e.g., out of stock, pricing error, failed checks), we’ll cancel and refund any payment.
3) Product information & availability
We aim for accurate descriptions, images, dimensions, and compatibility notes. Minor variations in colour/finish may occur.
Availability is shown on the product page but may change. If an item becomes unavailable after you order, we’ll offer a refund or suitable alternative.
4) Prices, VAT & obvious errors
Prices are in GBP and include UK VAT where applicable.
Delivery is Free UK (2–5 business days) unless stated otherwise; optional Express or bulky/pallet surcharges may apply and are shown or confirmed before dispatch.
If a pricing/description error is obvious and could reasonably be recognised as a mistake, we may cancel before dispatch and refund you.
5) Payment, security & verification
We accept the payment methods offered at checkout (e.g., Shopify Payments/Stripe/PayPal).
Payment is taken at checkout or on dispatch depending on the method.
To protect customers and our store, we may perform fraud checks and request additional verification or cancel/refund suspicious orders.
6) Promotions, discounts & gift cards
Promotions/coupons are subject to their stated terms, may be changed or withdrawn at any time, and cannot be combined unless we say so.
Gift cards are non-refundable and cannot be exchanged for cash (except where required by law).
7) Delivery, risk & title
UK delivery options and timelines are set out in our Shipping Policy. Standard delivery is Free UK 2–5 business days after dispatch.
Risk of loss/damage passes to you when the goods are delivered. Title passes when we receive full payment.
We aren’t liable for delivery delays outside our reasonable control, but we will keep you updated and take steps to minimise impact.
8) Large & pallet deliveries
Large/heavy products may be delivered by pallet/curbside service. Ensure safe access and that someone is present to receive delivery.
Drivers may not enter your property or assemble items. Redelivery charges may apply if delivery fails due to access or no-show.
9) Installation & safety
Follow the manufacturer’s instructions.
Gas appliances and hard-wired electrical items must be installed by a qualified professional (e.g., Gas Safe engineer).
We are not responsible for damage/injury caused by improper installation, misuse, or failure to follow safety guidance.
10) Your statutory right to cancel (distance selling)
You have 14 days from the day after delivery to notify us of cancellation for most online purchases (Consumer Contracts Regulations 2013).
After notifying us, you have 14 more days to return the items.
You must take reasonable care of the goods. For change-of-mind returns, you are responsible for return costs (see §12 and our Return & Refund Policy).
We will refund the product price and the standard outbound delivery cost (if any; upgrades like Express are non-refundable) within 14 days of receiving your return or proof of posting, to your original payment method.
11) Our goodwill returns policy (in addition to your statutory rights)
We offer 30 days from delivery for change-of-mind returns of unused, unassembled items in original packaging with all parts/accessories (see Return & Refund Policy for details).
For bulky items, we can arrange a paid collection and deduct the confirmed fee from your refund if you choose that service.
12) How to return items
Contact support@homeswingset.shop
with your order number to obtain an RMA and return instructions.
Pack items securely in the original packaging. Include the RMA paperwork.
Use a tracked service (or our arranged collection). Unauthorised returns may be refused or delayed.
13) Damaged, missing or wrong items
Please inspect on delivery and contact us within 48 hours with photos/video if there is transit damage, missing parts, or the wrong item received. We’ll replace, repair, or collect as appropriate at our cost.
14) Faulty goods & Consumer Rights Act 2015
If a fault appears within 30 days of delivery, you may be entitled to a refund or replacement (subject to inspection).
After 30 days, we’ll repair or replace within a reasonable time; if that’s not possible, you may receive a partial or full refund depending on the circumstances.
Manufacturer warranties may provide additional remedies—keep your proof of purchase.
15) Refunds: method & timing
Refunds are issued to the original payment method once returns are received and inspected.
We aim to process approved refunds within 3 business days of receipt; your bank/card provider may take 3–10 business days to post funds.
16) Non-returnable items (unless faulty)
Assembled/used goods, installed gas components, consumables, custom/special-order items, gift cards, downloadable content, and items marked Final Sale/Clearance.
17) Liability
Nothing limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under law.
Subject to the above, we are not liable for:
losses not caused by our breach;
losses that were not reasonably foreseeable when the contract was made;
business losses (we sell to consumers).
Our aggregate liability in connection with any purchase will not exceed the amount you paid for the relevant product(s), except where the law requires otherwise.
18) Events outside our control (force majeure)
We aren’t responsible for delay/failure to perform caused by events beyond our reasonable control (e.g., strikes, carrier failures, extreme weather). We’ll notify you and take reasonable steps to minimise the impact.
19) Resale & restrictions
Orders may be limited per customer/household to prevent reselling or abuse.
We may cancel and refund orders that breach limits or appear to be for unauthorised resale.
20) Data protection
We process personal data according to our Privacy Policy and applicable UK data protection laws. Non-essential cookies/marketing are used with consent where required.
21) Changes to these Terms of Sale
We may update these Terms to reflect changes in law or our operations. The version in force at the time you place your order applies to that order.
22) Governing law & jurisdiction
These Terms of Sale are governed by the laws of England & Wales. Disputes are subject to the jurisdiction of the courts of England & Wales. UK consumers may seek free advice from Citizens Advice.
